Refund Policy for our Longtail- and Speedboat Tours:
In case you can't attend the tour for any reason, you will get a 100% refund if you contact us via WhatsApp or Email at least 24 hours before the start of the tour. The money you paid will be credited to the payment method you have on file within 7 working days.
In case you don't show up or are an hour late we cannot refund you!
In case you miss the speedboat transfer due to late show up, you will have to pay for the speedboat tickets yourself! The tour will not be refunded!
After 24 hours before tour start all tours are automatically non refundable unless the customer has contacted us at least 24 hours before tour start via WhatsApp or Email!
Refund Policy for our Catamaran and Yacht Tours:
Cancel 30 days or more prior to the charter date = 100% refund of the deposit
Cancel 30 days or less prior to the charter date = No refund of the deposit
No show up on tour day: no refund of the deposit
During high season (November - April) full price needs to be paid as deposit in order to reserve the boat.
Due to circumstances in boat travel, the captain may spontaneously change the route and set a new destination for the protection of the passengers. It cannot be ruled out that the tour destination requested by the customer cannot be reached due to weather conditions or other environmental influences. No refund will be given.
GENERAL TERMS AND CONDITIONS (GTC) AND CONSUMER INFORMATION
General terms and conditions and consumer information in the context of sales contracts that are concluded via the online shop between the agent Phi Phi Tours, Germany (Sole Trader) in the name and on the behalf of the tour operator PHI PHI TOUR TH, Thailand - hereinafter referred to as "seller" - and the customer - hereinafter referred to as "customer". Info: Phi Phi Tours, Germany is an external travel agency with headquarter in Germany whereas PHI PHI TOUR TH, Thailand is the actual tour operator.
§ 1 Scope and general information
(1) Subject to individual arrangements and agreements that take precedence over these terms and conditions, the following general terms and conditions apply exclusively to the business relationship between the seller and the customer. Unless otherwise agreed, the inclusion of the customer's own conditions is contradicted.
(2) The customer is a consumer insofar as he concludes the contract for purposes that are predominantly neither commercial nor his independent professional activity. In contrast, an entrepreneur is any natural or legal person or a legal partnership who, when concluding a legal transaction, is exercising their commercial or independent professional activity.
§ 2 conclusion of contract

(4) The customer can select products/services from the seller's assortment and collect them in a so-called shopping cart using the "Add to basket" button. By clicking on the “shopping cart” button, the customer receives an overview of the selected products. With the "Buy it now" button, he places a binding order for the items in the shopping cart. Before submitting the order, the customer can change and view the entered order as well as the entered data at any time using the browser functions "Back" and "Next" shown as arrow keys. The binding order can only be transmitted if the customer accepts these terms and conditions by clicking on the "Buy now" button. The seller then sends the customer an automatic order confirmation by e-mail in which the customer's order is listed again and which the customer can print out using the "Print" function.
Right of withdrawal
You can revoke your contract declaration up to 14 days prior to the start of the tour without giving reasons in text form (e.g. whatsapp, line, email). The period begins after receipt of the order confirmation mail.

Consequences of cancellation
In the case of an effective cancellation, the mutually received services are to be returned and any benefits (e.g. interest) surrendered. If you are unable or partially unable to return or surrender the received service and benefits (e.g. benefits of use) or only in a deteriorated condition, you must compensate us for the value. You only have to pay compensation for the deterioration of the item and for any benefits drawn if the use or the deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. "Checking the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a shop. Dispatchable goods are returned at our expense and risk. Items that cannot be sent as parcels will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your declaration of revocation or the goods/ service, for us with their receipt.
End of revocation
The repayment will be made to the account you used for payment. In the case of payment on account, as well as transfer in advance, the transfer back will be directed to the account from which the transfer was made. If you have paid by PayPal / credit card, the refund will be made to the associated PayPal / credit card account.
§ 3 Subject matter of the contract, condition, delivery, availability of goods
(1) The subject of the contract are the goods and services specified by the customer in the context of the order and specified in the order and / or order confirmation at the final prices specified in the online shop. Errors and mistakes are reserved, especially with regard to the availability of goods. Speedboat and Longtailboat images may differ (in terms of color and model) from the actual speedboat or longtailboat.
(2) The quality of the goods ordered results from the product descriptions in the online shop. Images on the website may only show the products imprecisely; colors in particular can vary considerably for technical reasons. Images serve only as illustrative material and may differ from the product. Technical data, weight, dimensions and performance descriptions are given as precisely as possible, but may show the usual deviations. The properties described here do not constitute defects in the products supplied by the seller.
(3) If no copies of the product selected by the customer are available at the time of the customer's order, the seller shall notify the customer of this via whatsapp, line or mail. If the product is permanently unavailable, the seller will not make a declaration of acceptance. A contract is not concluded in this case.
(4) If the product specified by the customer in the order is only temporarily unavailable, the seller shall also notify the customer of this immediately in the order confirmation. If the delivery is delayed by more than two months, the customer has the right to withdraw from the contract. In addition, in this case the seller is also entitled to withdraw from the contract. He will immediately reimburse any payments already made by the customer.

Regarding the Longtailboat and Speedboat tours: We - Phi Phi Tours, Germany (Sole Trader) - are purely a placement agency and are not affiliated with the passenger transport companies, boat charter companies or captains responsible for the tour. As soon as a customer books a tour, the actual tour operator PHI PHI TOURS TH, Thailand then books and pays for speedboat tickets directly with a company of their choice. Then a taxi company selected by the tour operator with the utmost care will be contacted for the hotel transfer. The boat charter service is provided by the actual boat owner's company who the tour operator pays in advance for their service. The customer must adhere to the time specified by us for collection in advance and is responsible for all late arrivals. If the customer misses the speedboat transfer provided for the tour due to being late through their own fault, they must ensure that they get to Phi Phi Don themselves in order to take part in the private boat tour. All the captains that accompany our customers on their tour try their best to satisfy all customers. If the customer returns the speedboat transfer from Phi Phi Don because he asked for it or if he dawdled too much, the tour operators obligation to drop the customer back at their original hotel on the same day is automatically canceled and the tour plan loses its validity.
We assume no liability for any person or company involved in the tour, neither for the actions of our customers nor for the companies or captains commissioned by the tour operator who come into contact with the customer.
After the tour operator booked the speed boat tickets for the client, ordered the taxi for morning hotel pickup and afternoon port pickup, and appointed a boat charter company or a captain of their choice for a private boat tour for our clients, our service is fully rendered and done.

§ 11 final provisions
(1) The contract language is English.
(2) The laws of the Kingdom of Thailand and the Federal Republic of Germany applies to contracts between the seller and the customer, excluding the laws on the international purchase of movable goods. This choice of law applies to consumers only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer is habitually resident is not withdrawn from the customer.
(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the seat of the seller. This also applies if the customer does not have a general place of jurisdiction in Thailand, Germany or the EU, or if his place of residence or habitual abode is not known at the time the action is brought.
